What you buy is the credit that secures the house
You do not buy the house directly: you acquire the mortgage credit secured on it, at a closed price. When you sign before the notary you take the bank's place as creditor.
The essentials, in 10 seconds
The mortgage credit, an asset that is bought and sold
A bank lent money and secured it with a mortgage on the property. The loan was not repaid and there are already court enforcement proceedings.
That credit, with its mortgage, is an asset that can be transferred. The institution that holds the credit assigns it at a closed price, and whoever acquires it, before a notary, becomes the new creditor.
You are not buying a vacant home: you are buying the right to collect that debt, secured by the property. That is why, at the auction, you play from the position of creditor.

From the debt to your position
Three moments explain the whole journey.
Holds the credit and the mortgage on the property.
You take the bank's position in the proceedings.
Either you are awarded the property or you collect your credit plus interest.
Buying a house or buying a credit
| A standard purchase | The credit assignment | |
|---|---|---|
| What you acquire | The home | The mortgage credit that secures it |
| Price | Market price, negotiable | Closed price: the one you see is final |
| First payment | Deposit, often 10% | €5,000 reservation, paid directly to the institution that holds the credit |
| Rest of the price | At the notary, often with a mortgage | At the notary, in one go, no instalments |
| After the notary | You get the keys | Court proceedings and auction with your credit, with your lawyer |
| Result | You are the owner | Either you are awarded the property or you collect your credit plus interest |
What you pay
Illustrative example with a price of €150,000; it does not necessarily correspond to an available listing.
Before the notaryThe only thing you pay is the €5,000 reservation, directly to the institution that holds the credit, never to us. It is deducted from the price.
How it looks with a real property
Real example: studio in Costa del Silencio, Arona. You save: you use 130,386 € of credit that cost you 111,000 €. Where does the difference come from? The owner did not pay their mortgage and that debt is sold at a discount: the institution that holds the credit prefers to collect less, but right now. You buy the debt and the house stays as security. Then the house goes to auction: if nobody bids more, the house is yours; if someone bids more, you are paid the debt with the interest the court recognises.
What you receive and when
Before the reservation
Commercial information on the property: type, area, size, layout, condition, amount of the credit, price and timeframes.

Once the reservation is made
You receive by email the full information on the property and the case file, on a confidential basis.

At the notary
You sign the credit assignment and become the creditor.
This far, we go with you
Then, with your lawyer
You join the proceedings and the auction follows: either you are awarded the property or you collect your credit plus interest.
From here, your lawyer
What is protected
Your investmentThe credit assignment secures your investment. At the auction there are only two possible outcomes: either you are awarded the property, or you collect the credit you bought plus interest.
The €5,000 reservationIt is paid directly to the institution that holds the credit. You lose it if you withdraw voluntarily or, after paying it, you fail the AML (PBC) check because of problems with your documents or undeclared funds. We therefore recommend sending all the PBC documents before paying the reservation: if the check is not passed afterwards, the reservation is not refunded. If the deal does not go ahead for reasons beyond your control, the institution that holds the credit refunds it to you with interest.
TimeframesThey are set by the Court, not by us: each listing shows an approximate timeframe. The occupancy status of each property is also shown on its listing.
FAQ
Do I become the owner when I sign at the notary?
Can I pay with financing?
Can I visit the inside of the property?

L'essenziale, in 10 secondi
