¿Qué es una cesión de crédito?

El ejemplo de Mario (ilustrativo)

Mario pidió 90.000 € al banco con su casa como garantía y dejó de pagar. El banco tiene dos cosas: un crédito (lo que Mario debe: 90.351 €) y una garantía (la casa, valorada en ~180.000 €). Tú compras ese crédito por 74.000 €. Son cifras inventadas para explicar el mecanismo, no de un inmueble real.

Cómo avanza la operación

    Compras el crédito · firma ante notario

    Adquieres el crédito hipotecario ante notario a un precio cerrado. Pasas a ser el acreedor.

    Sucesión procesal

    Con tu abogado, te personas en el procedimiento judicial en lugar del banco.

  3. Fase 3 · Subasta

    Subasta judicial

    La vivienda sale a pública subasta. Aquí está el momento clave: los escenarios posibles.

  4. Fase 4 · Registro

    Adjudicación e inscripción

    Si la vivienda se te adjudica, se inscribe a tu nombre tras el decreto de adjudicación.

⏱️ Plazos: estimado ~8–12 meses si la ejecución ya está iniciada; bastante más si debe iniciarse. Cada expediente es distinto y el resultado no está garantizado.

En el ejemplo, tu crédito es de 90.351 €. Como acreedor ejecutante puedes pujar sin consignar la caución del 20% que se exige a los demás postores (arts. 647 y 669 LEC) y compensar con tu crédito.

Pujan por encima de tu crédito

La vivienda se adjudica a un tercero y el importe obtenido se aplica a tu crédito, hasta el importe reconocido en el procedimiento (en el ejemplo, 90.351 €). Si lo cobrado supera lo que pagaste por el crédito (74.000 €), la diferencia sería tu beneficio.

El matiz honesto

En el escenario C recuperas como máximo el importe reconocido de tu crédito: el exceso del precio de remate corresponde al deudor o a otros acreedores según la ley. Nada de esto está garantizado: depende del expediente, del juzgado y de las pujas. La operación conlleva riesgo.

In scenario C you recover at most the recognised amount of your credit: any excess of the auction price belongs to the debtor or to other creditors according to the law. None of this is guaranteed: it depends on the file, the court and the bids. The operation carries risk.
