Negociación bancaria

Negociación con el banco o el deudor (incluida la dación en pago) para cerrar la operación sin llegar a subasta. Requiere la cooperación de la otra parte.

¿Qué es?

La idea

En lugar de ir a subasta, se negocia directamente con el banco (titular del crédito) o con el deudor para alcanzar un acuerdo: por ejemplo, una dación en pago o una compra del inmueble pactada. Evita la incertidumbre de la subasta.

La ventaja

Cuando hay acuerdo, el cierre es más rápido y limpio que un procedimiento judicial, y se evita la subasta.

    Contacto y propuesta

    Se contacta con el banco/deudor y se plantea una solución (dación, compra pactada…).

  2. Fase 2

    Negociación y acuerdo

    Se negocian las condiciones. Depende de que la otra parte coopere (no garantizado).

  3. Fase 3 · Notaría

    Firma del acuerdo

    Se formaliza ante notario. Aquí termina nuestra intervención.

What is it?

The idea

Instead of going to auction, we negotiate directly with the bank (credit holder) or the debtor to reach an agreement: for example, a deed in lieu of payment or an agreed purchase. It avoids the uncertainty of the auction.

The advantage

When there is agreement, closing is faster and cleaner than a judicial procedure, and the auction is avoided.

L'idea

Invece di andare all'asta, si negozia direttamente con la banca (titolare del credito) o con il debitore per raggiungere un accordo: ad esempio una datio in solutum o un acquisto concordato. Evita l'incertezza dell'asta.

Il vantaggio

Quando c'è accordo, la chiusura è più rapida e pulita di un procedimento giudiziario, e si evita l'asta.
